Silurian.shop Physical Product Purchase Terms
Clear purchase, delivery, consumer withdrawal, returns and statutory conformity terms for physical-product orders.
Version 2026.08.6. These terms apply to physical products purchased through Silurian.shop. Before payment, the order identifies the product condition, quantity, unit price, applicable taxes, shipping charge, payment method and estimated delivery date.
1. Seller
The seller is Silurian SL, NIF B86389889.
2. Scope, contract language and order record
These terms govern the sale of physical products by Silurian to the customer named in the order. Until an official translation is published through Silurian's translation process, the contractual text is provided in English. The order confirmation, invoice and the version of these terms accepted at checkout form the order record, alongside any mandatory law that applies to the transaction.
3. Product information, price and order acceptance
Silurian aims to keep product information, availability and prices accurate. The catalogue price, applicable taxes, delivery charge and final amount are confirmed in checkout before payment. Stock and destination eligibility are revalidated immediately before order creation. A requested quantity may be divided between available sources only where the applicable price and delivery information are disclosed before payment. If a product is unavailable, cannot be delivered to the selected address, or contains an obvious price or product-description error, Silurian will promptly explain the issue and, where payment has been taken, refund the affected amount.
4. Payment and invoice
The checkout identifies the payment method and final amount. Silurian is the customer-facing seller; a payment authorisation is not a separate sale by a wholesaler. Silurian issues the applicable order and invoice documents through its billing system.
5. Delivery, address and receipt
Delivery is available only to the destinations shown in checkout. The customer must provide a complete and accurate delivery address and contact information. An order may be delivered in several parcels from different logistics locations without an additional charge after checkout. Each shipment is tracked separately in Workspace. If products or quantities have different estimated dates, the order-level estimate is the latest of them. Delivery estimates are not guaranteed dates and may change because of events outside reasonable control; Silurian will keep the available tracking information updated.
The customer should check the parcel and goods on delivery and report any apparent transport damage, missing item or incorrect product to Silurian without undue delay, with useful photographs where available. This helps resolve the incident quickly and does not limit mandatory rights.
6. Cancellation before fulfilment
A customer may request cancellation through Workspace or Silurian support before a shipment has entered fulfilment. Silurian will confirm whether cancellation remains possible. This operational option does not replace the statutory consumer right of withdrawal described below.
7. Consumer right of withdrawal
This statutory right applies only to a private individual acting outside that person's trade, business, craft or profession. It does not apply to purchases made by professionals, companies or other buyers acting for a business purpose, except where mandatory law requires otherwise.
For an eligible distance sale to a consumer in Spain, the withdrawal period is 14 calendar days from the day on which the consumer, or a nominated third party other than the carrier, takes physical possession of the goods. If one order is delivered in several parcels, the period starts when the last parcel is received. The consumer may withdraw without giving a reason using the statutory model form, the order area in Workspace or another clear statement sent to Silurian.
After communicating withdrawal, the consumer must return the goods without undue delay and no later than 14 calendar days after that communication. Unless Silurian states otherwise, or the goods are defective, damaged or incorrect, the consumer bears the direct return cost.
8. Statutory exceptions to withdrawal
Withdrawal is excluded only where the applicable law permits it. Relevant examples include goods made to the consumer's specifications or clearly personalised goods; sealed goods unsuitable for return for health-protection or hygiene reasons once unsealed after delivery; and sealed audio, video or computer software once unsealed. Any relevant exception is disclosed before purchase.
9. Refund after withdrawal
Silurian refunds eligible payments, including the legally required standard outbound delivery amount, using the original payment method unless otherwise agreed. The refund is made within the statutory period. Where law permits, Silurian may withhold it until the goods are received or adequate evidence of their return dispatch is provided. The consumer may inspect goods as in a shop; any diminished value caused by handling beyond what is necessary to establish their nature, characteristics and functioning may be deducted where legally permitted.
10. Returns, RMA and incorrect or damaged goods
For withdrawal, defect, transport damage or an incorrect product, open the order in Workspace or contact Silurian support before sending anything. Silurian may issue an RMA or return reference and will provide the correct return instructions. This traceability process does not restrict statutory withdrawal or conformity rights. Do not send goods to a supplier or warehouse address shown on a transport label unless Silurian specifically instructs you to do so.
Where goods are confirmed defective, damaged on delivery or incorrect, the customer will not be charged for return transport required for the applicable remedy.
11. Statutory conformity rights for consumers in Spain
These statutory conformity rights apply to consumers. For new goods sold to consumers in Spain, Silurian is responsible for a lack of conformity that exists on delivery and becomes apparent within three years from delivery. For second-hand, refurbished or open-box goods, a shorter period may be agreed but never less than one year; any agreed period is shown before purchase. A lack of conformity that appears within the first two years is presumed to have existed on delivery unless that presumption is incompatible with the nature of the goods or the lack of conformity.
The applicable remedy is repair or replacement free of charge unless impossible or disproportionate. If the goods cannot be brought into conformity within a reasonable time and without significant inconvenience, the consumer may be entitled to a price reduction or termination under applicable law. A manufacturer commercial warranty is additional and does not reduce these statutory rights.
12. Product condition and business purchases
New, refurbished and open-box products are identified separately. Silurian will not substitute a refurbished or open-box unit for a new product without the customer's express agreement. A business purchase does not receive the consumer withdrawal period in section 7; its rights and remedies are those agreed in the order and those that mandatory law grants to that business transaction.
13. Privacy, support and applicable law
Silurian processes personal data needed to take payment, deliver the order, provide support, manage returns and comply with legal obligations as described in the Privacy Policy linked below. Questions and notices may be sent through Workspace or Silurian support. Spanish law applies without depriving a consumer of mandatory protections of the consumer's country of residence. Competent courts are determined by mandatory jurisdiction rules.
